Real estate property transfer at the Dubai Land Department

Property transfer occurs in two ways, namely by way of sale and by way of gift transfer.
Property is transferred by way of sale when the transaction is in non-blood relation. In this case, the Dubai Land Department levies 4% transaction fees.
On the other hand, a blood relation transaction is when the property is transferred from a father to their children, or in another example, from a husband to a wife, or in a further example, through a company to its shareholders. This kind of transaction is also called a gift transfer.
In case of a gift transaction, the Dubai Land Department fees are much lower and this is currently at 0.125%.
If one or more of the parties are absent, then the transaction is completed by way of a power of attorney (POA).
In terms of other documents that are required, these are an NOC from the developer and a valuation certificate to determine the current value of the property.
In addition, for a blood relation transaction, documents such as a birth certificate, marriage certificate or certificate of incumbency may be required as well.
